I understand that tumbling, cheerleading camps, competitions, practices, clinics and gym equipment have an inherent danger in participation and that in spite of all precautions and accident preventatives, injuries do occur. I further acknowledge that each participant has elected to participate in Envy Athletics LLC at their own risk and will not hold Envy Athletics LLC, employees/ instructors liable for any and all injuries that may occur while participating in cheerleading. The risks involved in respect to such a program are fully understood. It is hereby agreed that I, my child/adopted or otherwise, my executors, waive and release all rights and claims for damages that I or my child may have at any time against Envy Athletics and their representatives whether paid or volunteer, for any injury, permanent disability, or death in connection with all of Envy Athletics programs or other activities related to Envy Athletics.
In exchange for participation in the activity of Cheerleading and Tumbling organized by Envy Athletics, use of the property, facilities and services of Envy Athletics, I agree for myself and (if applicable) for the members of my family, to the following:
- I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Envy Athletics, or the employees, representatives or agents of Envy Athletics.
- I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Envy Athletics for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Envy Athletics, whether caused by the fault of myself, my family, Envy Athletics or other third parties.
- I agree to indemnify and defend Envy Athletics against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Envy Athletics.
- I agree to pay for all damages to the facilities of Envy Athletics caused by my or my family's negligent, reckless, or willful actions.
The undersigned does hereby grant Envy Athletics LLC and its successors, the unrestricted right to use the undersigned's name, likeness, or appearance on any calendars, photographs, tryout flyers, video material, film material, computer software, computer hardware, electronic online services, or other similar promotional material in any form, content or medium to promote or market Envy Athletics LLC. The undersigned does hereby expressly release and waive any demand, action, claim, license, royalty, or other form of payment the undersigned, and his or her agents, representatives or assigns, may have based on claims of the undersigned as to rights of privacy, publicity, notoriety or any other rights arising out of or relating to any use by Envy Athletics LLC of the undersigned’s name, likeness or appearance.
